I guess we all must have read by now about lawsuit related to Word 2007's custom XML usage and Court-ordered patch removes custom XML tools from Office 2007 components.

I have been using this feature of injecting custom XML in Word 2007 docx files extensively for doc generation.
Can we still use custom XML fragments in OpenXML package for Word 2007 docs for server side document generation? If not, what's the alternative?
BTW, here's the link to download the patch if OEMs want to disable this functionality.
